CENTURION FIELDS – DEVELOPER AND COUNCIL SIGN OFF OF THE SITE

As a result of the recent meeting between the Managing Agents and the residents of Centurion Fields I raised a query with the Council in relation to what is acceptable before the Council will sign off the site. A number of snagging issues do remain and I and the residents in attendance felt that these should have been dealt with before it was handed by the developer to the managing agents. I took this up with the relevant Council officer who responded as follows:

“When a developer requests the adoptable highway works, as part of the S38 Agreement of a new development, are progressed to Provisional Certificate(PC) or Final Adoption (FC) they have to provide the following information:

 For PC we require the following:

    • Signed S38 Agreement in Place
    • The development must be complete
    • Yorkshire Water Provisional Certificate of Adoption and accompanying plan
    • All signage/lining must be in place (20mph signs, road hump signs, Street Name plates etc.)
    • The highway works, as part of the S38 agreement, within the development must have been inspected and passed by the S38 Highway inspector
    • Street Lighting installed, commissioned  and adopted by Leeds City Council
  • Easement for Highway drainage – Need to see proof of Easement (If applicable)

 

  • Highway Adoptable Structures – Inspected and passed by LCC Highway Structures Team (If applicable)
  • Adopted Landscaping – Passed by LCC Landscaping Team(If applicable)
  • No loose material next to the adopted highway
  • Stage 3 Safety Audit (If applicable/required by Leeds City Council)

For FC we require the following:

  • Leeds City Council S38 Provisional Certificate in place
  • Yorkshire Water Final Certificate of Adoption and accompanying plan
  • Gully cleaning and proving – evidence required to show this has been completed
  • The development must have been inspected and passed by the S38 Highway inspector. If any remedial work is required it must be completed by the developer to the satisfaction of the S38 Highways Inspector.
  • Stage 4 Safety Audit (If applicable/required by Leeds City Council)

The S38 highway snagging works are agreed at a site meeting between our S38 inspector and a representative from the developer, in this case BDW. The developer will then complete any required works requested. Once these works have been completed they will contact the inspector to re-visit the site. If everything is OK the inspector will contact the office and confirm they are happy with the remedials. It should be made clear that only the highway works as part of the Section 38 Agreement are covered with this process. Any private drives/roads, not offered for adoption under the S38 Agreement, will not have any defects rectified under this procedure. “
