As you may be aware Leeds’ Site Allocations Plan (SAP) was submitted to the Secretary of State for independent inspection back in October 2017. In July and August 2018 public hearings concluded and I spent many days representing residents’ views to the Inspector. The Inspectors have now published what is called their Main Modifications to the SAP. These proposed Main Modifications are what the Inspectors feel is necessary to make the plan “sound”.

The proposed Main Modifications only will now undergo a further 6 week public consultation. One of these modifications affects the site east of Otley Road in Adel currently the subject of planning application 18/04343 for up to 100 houses by Barratt David Wilson Homes.

The reason given for this change is “Error in calculation of capacity of site in making allowance for the area for school provision.” I wrote to the Council to ask for an explanation for this error. They advised as follows:

“In response to your email, the revision in the site area for the Church Lane, Adel site (HG2-18) is a result of further work undertaken following a query raised at hearing sessions on the SAP, on a different site at HG2-72 Tyersal Court, Tyersal which is also a split housing and school allocation. The methodology for calculating site capacities for sites such as these was reviewed  by the Council to the SAP Inspectors satisfaction and is explained and set out in action 26 of Examination Document EX75 (October 2018). The revisions relate to the net developable area of sites and when the area of the school is deducted from the site area to calculate the overall housing capacity. Consequential changes to the affected sites are made by the Proposed Main Modifications. 5 sites in 5 different wards and HMCAs are subject to Proposed Modifications arising from this revision to the site capacities (Proposed Modification 62.HG2-36 Alwoodley Lane, Alwoodley; 82. HG2-18 Church Lane, Adel; 89.HG2-180 Fleet Lane & Methley Lane, Oulton; 116.HG20-150 East of Churwell; and 140.HG2-72 Tyersal Court, Tyersal).  

It is acknowledged that the site capacity has been subject to a number of revisions arising from the need to exclude the eastern area of the site and the existing housing on the site from the developable area and to rectify address an error identified. It has not been due to pressure from the site applicant.     

At the time of consideration of the outline application for Church Lane, Adel (16/06222/OT) which was granted in November 2017, the correct housing capacity at that time was referenced in the Local Plan consultation response. The revised capacity of 104 units was a consequential revision identified in response to the examination hearings last Summer. EX75 cross refers to paragraph 2.42 of the SAP which confirms that the capacities listed in the SAP “can only be an indication of what could be achieved on a site – when a detailed planning application is submitted, this may be higher or lower, depending on the specific details of the application.”  

The outstanding application (18/04343/RM) proposes up to 100 dwellings. As set out in the SAP, the appropriate stage to consider the site specific considerations in detail including the number of dwellings, site layout and design is the detailed application stage which is currently being undertaken. 

The site allocation HG2-18 has been considered consistently and fairly using the same methodology as other sites assessed through the SAP process.”

The Council is about to start its Core Strategy Review which is also a public inquiry and will look at housing numbers up to 2033. This will take place from 4th February for 5 days and the same Inspectors will be hearing evidence. I will be present at this Inquiry.

You may wish to make representation during the 6 week consultation period on this change. The consultation runs from 21st January until 5pm on 4th March 2019. This only relates to the proposed Main Modifications therefore only comments related to that will be considered by the Inspector.
